HULETTS EQUISWEET COMPETITION RULES (“RULES”)

1. The promoter is Tongaat Hulett Limited Reg. No. 1892/000610/06 (in business rescue) (“the Promoter”) and Gorilla Tactical Marketing Specialists (Pty) Ltd t/a Gorilla Creative Media Reg. No. 2016/078944/07 acting as the Agent of the Promoter.
2. This promotional competition is open from 23 October 2023 and ends at 11:59 pm on 3 December 2023. Any entries received after the closing date will not be considered.
3. This promotional competition is open to all South African citizens residing in South Africa, in possession of a valid identity document, except any director, member, partner, employee, agent or consultant of the Promoter, it’s marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members.
4. Any participant under the age of 18 years must be fully assisted by his/her guardian, who approves and consents to the participant’s participation in the competition and the participant’s receipt/possession of the prize.
5. To enter, participants will be required to:
   1. Buy any 2 EquiSweet products from any Checkers retail store in South Africa.
   2. Swipe their Checkers Xtra Savings Card
   3. Participants must keep their till slip or invoice as proof of purchase.
6. Participants may enter a maximum of 3 (three) times, provided that each entry is associated with a new purchase, and on a separate till slip or invoice.
7. All winners will be required to provide their names, ID numbers and contact details to sign an acknowledgement of receipt of the prize.
8. All winners must provide their correct contact details in terms of clause 7 above. If a winner has given incorrect contact details, the Promoter reserves the right to select another winner in terms of the Rules.
9. The Prizes are as follows:
   1. 1 (One) trip to Zanzibar valued at R52 980 excl. VAT. This prize is inclusive of the following:
      1. Two flight tickets to Zanzibar. The flight is inclusive of connecting flights within South Africa in the event of the Winner not residing in Johannesburg;
      2. Airport transport in Zanzibar for two;
      3. Accommodation at a 4* Hotel in Zanzibar for 7 nights all-inclusive of meals and drinks at the Hotel;
      4. The travel period excludes December and January
      5. The winners have 8 months from when they have been contacted to book their trip.
      6. Travel insurance includes repatriation of mortal remains as a standard inclusion and the following: emergency medical and related expenses for illness or injury, pre-existing emergency medical and related expenses, accidental death, accidental permanent total disablement, international journey cancellation, personal liability, luggage, car rental excess waiver, travel delay, missed connection, international journey postponement.
      7. The Winner must note that any trips, sight-seeing, and/or tours planned while in Zanzibar as well as any drinks or meals not purchased at the Hotel will be for the cost of the Winner. The Promoter and its Agents shall not be liable for any cost in this regard save for what is specifically included in the prize.
   2. 10 (Ten) Cash prizes valued at R5000,00 (Five Thousand Rand) each.
10. Winners will be selected by means of a random draw by 10 January 2024. There will be 1 main winner drawn with 10 runner ups to win R5000,00 each. Winners will be contacted within 2 weeks of the draw. Winners will be notified telephonically, where the winner will be required to verify their details.  The Promoter (or their agent) will endeavor to contact the prize winner once every day for 3 consecutive working days after their name is drawn.  If the prize winner cannot be contacted during this period, the prize will be forfeited, and another winner will be selected in accordance with the Rules. The winners will have 3 days from the date on which they are successfully contacted to provide their documents. If the required documents  are not received, the prize will be forfeited, and another winner will be selected in accordance with the Rules
11. In the event that the prize is not available despite the Promoter’s reasonable endeavors to procure the prize, the Promoter reserves the right to substitute the prizes for equal value.
12. The prize is not exchangeable for cash and is not transferrable.
13. Any prize not taken up for any reason, within two months after a Winner in terms of prize 9.1 has provided the required documents and within two months after the Winners in terms of prize 9.2 has been successfully contacted, will be forfeited.
14. The prize includes delivery, and winners will be required to provide the Promoter with a valid daytime delivery address to enable delivery.
15. The Promoter reserves the right to name winners publicly and in any other place where the Promoter deems fit. By entering the competition, prize winners agree to the publication of their name by the Promoter.
16. The Promoter reserves the right to use the images taken of the winner for publicity purposes in any manner they deem fit, without remuneration being made payable to the winner. However, the winner has the right to object to these images being used by written notification to the Promoter at [email protected] , Att: Legal Department.
17. Failure to claim the prize or a refusal or inability to comply with the terms and conditions of this competition within 2 months of a Participant being notified that they have been selected as a winner of this competition will disqualify the winner, and a new winner will be drawn in their place at the sole discretion of the Promoter.
18. Personal Information provided by any participant by entering this competition will be processed in accordance with the Protection of Personal Information Act, 2013 (Act No. 4 of 2013) read together with the Tongaat Hulett Privacy Notice (https://www.hulettssugar.co.za/privacy-notice/). By entering the competition the participant consents to their personal information being shared with the Tongaat Hulett employees, contractors or agents for the purpose of this competition, for the purpose of sharing future promotional competitions and used for the purposes contemplated in clause 16 and 17 above. The winner hereby releases, discharges, and agrees to indemnify and hold harmless the Promoter and their agents from all claims, demands, and causes of action they have or may have by reason of this authorization or use of their pictures, digital images, including any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of said images or videotapes, or in processing tending towards the completion of the finished product, including publication on the internet, marketing, in brochures, or any other advertisements or promotional materials.
19. By virtue of entering this competition the Participants consents to their information being stored for a period of 3 (three) years from the date on which this competition ends. The Promoter reserves its right to outsource the storing of information to a reliable Third Party. The Promoter warrants that the information will be stored in accordance with clause 16 above.
20. The Promoter and/or its Agent shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever. The Promoter shall not be responsible for the failure of any technical element relating to this promotion that may result in an entry not being successfully submitted.
21. The Promoter and/or its Agent shall not be responsible for any entries that are lost, damaged, or delayed as a result of any network, computer or cell phone hardware or software failure of any kind.
22. The Promoter reserves the right to disqualify any entry and associated entries if fraud or cheating is suspected, including without limitation, any attempt to use multiple e-mail addresses, profiles, contact details or Meta accounts or other tactics to enter more than the stated limit or through the manipulation of code or otherwise frequently falsifying data.
23. No applications from agents, third parties, organised groups, or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions.
24. The Promoter shall have the right to change or terminate the promotional competition immediately and without notice, if deemed necessary in its opinion and if circumstances arise outside of their control.  In the event of such change or termination, all participants agree to waive any rights that they have in respect of this promotional competition and acknowledge that they will have no recourse against the Promoter or its agents.
25. Neither the Promoter, its agents, its associated companies, nor any directors, officers, or employees of such shall be liable for any loss, damage, or injury (including death), whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant.
26. A copy of these Rules can be found on the following website: hulettssugar.co.za throughout the period of the competition. Participation in the promotional competition constitutes acceptance of these Rules and participants agree to abide by the Rules.
27. This promotion is in no way sponsored, endorsed, or administered by, or associated with Meta and the participants acknowledge that they are providing information to the Promoter and its agents only and not to Meta. All participants in this Competition release Meta and any other online platforms from all liabilities and claims arising out of or in connection with this competition and these Rules.
28. This promotion is in no way sponsored, endorsed, or administered by, or associated with Telkom, MTN, Vodacom, Cell C or any other mobile network and the participants acknowledge that they are providing information to the Promoter and its agents only and not to telephone networks.
29. All participants in this Competition release Telkom, MTN, Vodacom, Cell C and any other mobile network from all liabilities and claims arising out of or in connection with this competition and these Rules.
30. The judges’ decision is final, and no correspondence will be entered.
